Application to review directed TRANSFER –– s.146(1)(h) of the Victoria Police Act 2013 –– Decision to transfer Applicant from St Kilda Uniform to Kerang Uniform made under section 35 (“reasonably necessary to do so for the provision of policing services”) following the General Duties Allocation Committee process (GDAC) –– additional documents sought to be admitted –– Board not satisfied exceptional circumstances to admit (section 149(2)) –– Applicant applied for two of the ten metropolitan priority positions offered, but did not apply for North West Metro (NWM) Division 4 or 5, claiming travel time would be excessive, Board considers that claim disingenuous –– Applicant would have been offered NWM Div.4 if he had applied –– applied for ballot exemption on basis that his partner is employed by Victoria Police in a VPS role, would not be able to work from Kerang, would be difficult for her Unit if she left –– Board considered public interests in: ensuring policing services provided to the community; integrity of the GDAC process; holding people to the commitments given on joining Victoria Police; not satisfied that Applicant’s partner would be unable to secure alternative employment, notes options for flexible work and support from Victoria Police not satisfied transfer would result in significant and irremediable loss or hardship –– concludes that transfer would not be harsh, unjust or unreasonable –– decision to transfer affirmed (section 153(2).
